Terms of Service

1. Introduction

These Terms govern your use of the AI Song Gift Maker mobile application and related services, including AI-powered music and lyric generation, Gift Song Maker, AI Song Lab, Explorer/Player, and personal Library & Downloads. The App is intended for creative and entertainment purposes.

2. Eligibility

You must be at least 13 years old (or the minimum age required by your local law). If you are under 18, use requires parental or guardian consent.

3. Accounts

• Sign in with Google, Apple, or email. Keep credentials confidential.
• Do not share accounts or impersonate others.
• We may suspend or terminate accounts that violate these Terms or applicable laws.

4. Features & Usage

• AI Song Generator — create songs from prompts or lyrics.
• AI Lyric Generator — generate and edit lyric suggestions.
• Giftmaker — personalize musical gifts with messages and visuals.
• Trending/Explore — discover community-made songs.
• Library & Downloads — save creations locally for personal listening.
• Premium Plans & Credits — subscriptions/credit packs unlock advanced features.

Outputs are generated by AI and may vary. You are responsible for your inputs and how you use the outputs.

5. Ownership & Copyright

• AI-generated songs/lyrics/media are licensed to you for personal, non-commercial use unless you hold an active Pro Unlimited plan, which grants limited commercial rights.
• You may not sell, redistribute, or commercially exploit generated content without written permission from VALUE TRIBE LLC.
• The App and all related IP (software, brand, designs) are owned by VALUE TRIBE LLC.
• By submitting prompts/lyrics, you confirm you own or have rights to them and they do not infringe others’ rights.

6. AI Content Disclaimer

Outputs are produced by machine learning models and may inadvertently resemble existing works. We do not guarantee uniqueness, originality, or copyright clearance. Review outputs before sharing or commercial use; you are responsible for compliance with applicable laws.

7. Subscriptions & Credits

• Some features require subscriptions or credit packs.
• Payments are processed by Google Play or Apple App Store. Prices may vary by region.
• Subscriptions auto-renew unless canceled at least 24 hours before renewal in your store settings.
• Each song creation consumes credits. When credits are exhausted, additional credits must be purchased.
• Refunds follow the respective store policies and applicable law.

8. Acceptable Use

• No illegal, hateful, violent, or sexually explicit content.
• No reverse engineering, scraping, model extraction, or bypassing payments/quotas.
• No infringing uploads or misleading content.

9. Sharing & Community

• Users may share songs with in-app playlists, charts, and personal collections (where available).
• Shared content must comply with these Terms and applicable laws.
• We may remove or suspend content or accounts that violate policies.

10. Refund Policy

• Refund requests are processed via the Apple App Store or Google Play Store and are subject to their policies.
• VALUE TRIBE LLC cannot process refunds outside those platforms.

11. Limitation of Liability

The App is provided “as is,” without warranties of any kind. VALUE TRIBE LLC is not liable for losses from use or inability to use the App, inaccuracies in AI outputs, or incidents beyond reasonable control.

12. Changes to Terms

We may update these Terms from time to time. Updates take effect upon publication in the App or at songwish.app/terms-of-service. Continued use constitutes acceptance.
